The College of Law at the University of Karbala hosted Professor Dr. Ali Sahib, Dean of the College of Law at Warith Al-Anbia University, as a member of the committee to discuss a master’s thesis in the Public Law branch on the responsibility of the Iraqi Speaker of Parliament – a comparative study, submitted by the student Muhammad Hadi Hamza.
The study aimed to identify the responsibility of the Speaker of Parliament, the basis of his responsibility, and the types of his responsibilities, in addition to determining the oversight of the work of the Speaker of Parliament and how to establish his responsibility, and the extent of the authority of the Federal Supreme Court to try him.
The study concluded that the position of the Speaker of the Iraqi Council of Representatives is a constitutional position according to, but in terms of the legal nature of this position, it is classified within the category of those charged with public service, and not within the category of public employees. The criminal responsibility of the Speaker of the Council of Representatives is a precise and complex legal concept, as this position requires a high level of independence and legal immunity to protect its occupant from political pressures and unlawful prosecutions. In addition, the Constitution of the Republic of Iraq for the year 2005 did not include the issue of dismissing the Speaker of the Council of Representatives clearly, as it left the matter to subsidiary legislation. This issue was referred to in the internal regulations of the Council of Representatives for the year 2007, as well as in the Law on the Replacement of Members of Parliament No. (6) of 2006, as amended.
